The application has been filed before Additional Chief Metropolitan Magistrate Kamini Lau through his counsel Charanjit Singh Bakshi, the same court which is enquiring into the extradition proceedings against Kohli.

According to the bail application, the post-mortem report of deceased Hannah Foster, cited by Kohli's counsel as an "extremely vital document", nowhere indicates that she was raped, which is allegedly the motive of the murder.

Kohli has also challenged the DNA analysis, which as done in the present case (on the basis of "Likelihood Ratio") is not conclusive evidence in medical science.

Bakshi said, "Kohli has also disputed that he ever evaded the law, as he had already planned to visit India to attend to his mother who had met with an accident, much before the incident."
