The district magistrate and returning officer of Darjeeling Lok Sabha seat, Surendra Gupta, today said the notice was served on Gurung last evening, asking him to explain within 72 hours as to why action should not be taken against him for uttering abuses against the two ministers.

According to Gupta, he and Assistant Returning Officer Sarad Dwibedi had examined the CD of a public rally at the Hindi High School ground here on April 25 where Gurung had allegedly termed the chief minister and the urban development minister as janwars (beasts).

Asked to comment, GJM general secretary Roshan Giri said over phone, "We will do the needful as we believe that the Election Commission is impartial."
