Government on Friday approved for accession to the Hague Convention of 1965 to improve the organisation of mutual legal assistance in civil or commercial matters by establishing a legal basis with a large number of foreign countries.
Briefing reporters after a meeting of the Union Cabinet chaired by Prime Minister Manmohan Singh, Finance Minister P Chidambaram said the decision for the instrument of accession would be helpful in seeking cooperation in the services of judicial processes or other documents in civil and commercial matters.
Union Law Ministry has been declared as the Central Authority, a pre-requirement under the Hague convention on the service abroad of judicial and extra-judicial documents in civil and commercial matters, he said.
Under the convention, where the parties to a case before an Indian court reside abroad, it will provide reliable means of ensuring that the summons and documents are served on them besides being helpful in reducing the number of appeal cases at least on the ground of non-service of documents.
After accession to the convention, separate arrangements with the states signatory to the convention would not be required, he said adding the Instrument of the Accession would be deposited with the Foreign Ministry of the Netherlands.
