In a big relief for the Delhi-Gurgaon Expressway operator that was served a contract termination notice by the National Highway Authority of India (NHAI) for allegedly violating terms of the agreement earlier this month, the Delhi high court has restricted the government agency from taking any action.
On Wednesday, the high court issued a notice to the highway authority and directed the expressway concessionaire firm, DSC Limited, to file a reply with NHAI on the notice by January 4, 2012. The court further directed the NHAI and DSC to, within 10 days thereafter, jointly discuss and find a mutual solution to the issues raised in the notice.
According to a DSC spokesperson, the firm had moved court on December 19 seeking a stay on termination of contract on the basis of the NHAI notice issued on December 7.
The nodal agency that builds highways across the country had served a termination notice to DSC for violating several terms of the agreement between them. The concessionaire firm was given 15 days’ time to respond to the charges levelled against it.
