HEARING A Public Interest Litigation, the Allahabad High Court has directed the Allahabad Development Authority (ADA) not to sanction any ‘complex’ or otherwise within the city — particularly Civil Lines, Chowk and Katra, Allahabad- without referring the plan and obtaining ‘no objection certificate’ from the Chief Town Planner at Lucknow for the time being, who shall look into all aspects before granting sanction to proposed complex.

Passing this order, a Division Bench comprising Justice AK Yog and Justice Prakash Krishna observed, “Considering the existing situation, we find no justification for any multi-storeyed complex to be raised in Civil Lines area.”
The court directed the ADA authorities to review ‘plan’ of Civil Lines area particularly markets which have been sanctioned but not yet raised/constructed considering ‘hell like’ traffic and parking problems in the area.“No complex be allowed to be constructed/raised any more and if so, in initial stage, only below ground levels. It should not be allowed to go beyond ground level. A general notice be given for the same. Any activity in violation of this order shall be treated as gross violation of order of this court,” the Court directed. The Court has directed the ADA to ensure that parking places indicated in the sanctioned plan of the complexes/constructions in the city and particularly in Civil Lines, Chowk and Katra are restored forthwith.
The court directed that persons/authority using parking space otherwise or not permitting public to use it should be noticed to restore the parking place within one week and if he fails to do so, the premises in question be sealed. Besides, the ADA may also take such action against the guilty as may be permissible under the law.

The PIL has sought removal of encroachment and unauthorised constructions from Allahabad.The Court has asked the Chief Standing Counsel (CSC), representing state government, to ensure presence of Chief Town Planner and Chief Town Planner and Principal Secretary, Nagar Vikas who may have a round of the city with SK Garg, convenor of the Committee, Chief Standing Counsel, petitioner Anand Mohan, and submit their report on multi-storeyed complexes, traffic turmoil and public tragedy on these scores.
The court has also asked the convenor of the committee SK Garg to submit a report fortnightly in chambers about the programmes of the work about Curzon Bridge and parks of the city.
