THE ALLAHABAD High Court, on Wednesday dismissed all four writ petitions filed by UP Cricket Association and three others, challenging the validity of the UP Sports (Regulation and Registration) Act 2005. Under the Act, all sports associations of the state were required to compulsorily register with the Registrar of Societies (Registration).
A Division Bench, comprising Justice Sushil Harkauli and Justice Vikram Nath, dismissed the writ petitions after hearing the counsel for the petitioner and the additional advocate general SMA Kazmi, who represented the State Government.
During the course of hearing, the additional advocate general pointed out that, in the writ petition, the UP Cricket Association had sought relief in the capacity of a society. Subsequently, the character of the association was changed and incorporated as a company under the Companies Act. Therefore, Kazmi argued that the writ petition was not maintainable.
