A division bench comprising Chief Justice A K Patnaik and Justice S C Sinho served notices on these students after the petitioner’s counsel Aditya Sanghi informed the court that his client, renowned surgeon Dr V K Jain of Indore, was receiving threatening calls to withdraw the petition. The court observed that the students should be given opportunity to clarify their stand on the admission before passing the final order.

Further, the court said since this petition is a PIL, the court won’t allow the petitioner to withdraw it because serious allegations are made against three students who did not score requisite marks and were given admission.

The PIL alleged the management of Shri Aurobindo Institute of Medical Sciences ignored the minimum 50 per cent passing marks criteria in entrance test, while giving admission to the students. The PIL said these students had scored below 50 per cent marks in the entrance test 2005.
