THE LUCKNOW bench of the High Court has stayed the annual general election of the Central Bar Association (CBA) of the civil court scheduled for December 18.
Justice AN Verma passed the above orders on Thursday on the basis of a writ petition filed by two former presidents of the CBA including KC Bhasin, Raj Kumar Yadav and others.
It was urged on behalf of the petitioners that the forthcoming CBA elections was not being held in accordance with the model bye-laws framed by the UP Bar Council, hence it should be stopped. It was further argued that the model bye-laws of the UPBC were aimed at providing clean image to the bar by prohibiting non practicing advocates from contesting the election and providing a minimum length of practice for a particular post etc and it should be strictly adhered to.
Meanwhile the opposite party urged that the model bye-laws of UPBC were not mandatory. Senior advocate Umesh Chandra appeared on behalf of the petitioners while HS Jain represented the respondents. The matter will come up for hearing on January 5, 2007.
