HC takes note of cops? conduct

THE ALLAHABAD High Court has taken a serious note of the accused police personnel?s non-appearance before the court for the last 21 years. Despite non-bailable warrants issued to them by the trial court, they did not appear before the court.

THE ALLAHABAD High Court has taken a serious note of the accused police personnel’s non-appearance before the court for the last 21 years. Despite non-bailable warrants issued to them by the trial court, they did not appear before the court.

In an order passed on Wednesday, Justice Vinod Prasad asked the additional government advocate (AGA), representing the State Government, to seek instructions as to what action has been taken against the accused who are police officials?

The court has also asked the AGA to seek instructions from the director general of police UP as to why the accused who are in police service of the State are not appearing before the court in spite of repeated orders passed by the trial court at Jaunpur and non-bailable warrant issued to them?

In the petition, filed by Onkar Nath, resident of village Panwara district Jaunpur, it has been alleged that he filed a complaint against the police officials (posted at that time at Panwara police station of Jaunpur), on which the chief judicial magistrate of Jaunpur had summoned the accused police officials under sections 147, 323 and 325 of Indian Penal code (for causing injuries). But in spite of repeated orders and non-bailable warrants issued by the court and directions to the principal secretary (Home) and to superintendent of police, police headquarters at Allahabad, the accused police officials are not appearing before the court.

To recall, the warrants for appearance have been issued against Surendra Nath Yadav (then SO of PS Panwara, Jaunpur), Vinod Tiwari, Sub-inspector and also against constables Samar Bahadur, Ram Kishan, Rajendra Prasad, Mohd Ibrar, Deo Nath, Nand Lal and Balbhadra, all posted at Panwara police station at that time.
