A special court trying the disproportionate wealth case against AIADMK chief Jayalalithaa on Tuesday adjourned the hearing to July 23 on her petition seeking documents on the basis of which the Tamil Nadu Government is asking for permission to withdraw the London Hotel case.
Jayalalithaa's counsel Navaneet Krishnan reiterated that his client is entitled to the documents in accordance with law when the case came up for hearing on Tuesday.
The counsel argued that Jayalalithaa was not opposed to the application filed under Section 321 of the CrPC (withdrawal of prosecution), but she is entitled to get copies of the documents filed.
The application is between the court and the public prosecutor, but Jayalalithaa has the legal right to file a revision petition before the High Court in case of the petition's dismissal, Krishnan said.
As per CrPc provision, even the police were duty bound to provide copies of the documents and statements, he argued.
On April 30, the Tamil Nadu Government filed a plea before the court seeking permission to withdraw the London Hotel case, one of the disproportionate asset cases filed against former chief minister Jayalalithaa and four others.
On May 25, Jayalalithaa moved an application seeking the documents on the strength of which the Tamil Nadu Government was withdrawing the case against her.
