He is charged with an attempt to murder after he rammed his car into police constables.

A division bench of Justice JN Patel and Justice RS Mohite directed Khatau on Monday to first make an application before the trial court confirming his bail as per the legal provision.

On December 29, 2006, after Khatau returned from London, he was formally arrested by the police after he surrendered before the Marine Drive police station. He was released the same day on interim bail by the HC.

In April last year, the sessions court acquitted Khatau in a hit-and-run case. The government had challenged his acquittal before the HC, which was admitted on December 20, 2006.

Once the appeal against acquittal is admitted by HC, process is issued under law and the person has to be taken into custody.

Following the accident, Khatau fled from the scene. However, he was intercepted ahead by the Marine Drive mobile unit and was taken into custody.
