Marriage registration bill tabled in TN Assembly

A new bill for “compulsory registration of all marriages in the State,” called the “Tamil Nadu Registration of Marriages Act 2009,” was piloted in the Legislative Assembly on Tuesday by State Law Minister Mr Durai Murugan. MR Venkatesh reports.

Registration of all marriages that take place in Tamil Nadu will be made compulsory soon.

A new bill for “compulsory registration of all marriages in the State,” called the “Tamil Nadu Registration of Marriages Act 2009,” was piloted in the Legislative Assembly on Tuesday by State Law Minister Mr Durai Murugan.

This legislation was in accordance with the Supreme Court’s judgment in the “Seema Vs Ashwani Kumar (AIR 2006 SC 1158)” case which said that the “effect of non-registration would be that the presumption available from registration of marriage would be denied to a person whose marriage is not registered,” the minister said in the statement of objects and reasons appended to the Bill.

The Supreme Court is of the view that the marriages of all citizens of India , belonging to various religions, should be compulsorily registrable in the respective states where the marriage is solemnized, Mr Murugan said.

Hence, Tamil Nadu considered it necessary to “make a new Law to ensure effective implementation of compulsory registration of all marriages that takes places in this State,” Mr Murugan said.
