MCA water connection plea quashed

A petition filed by the Mumbai Cricket Association challenging the Brihanmumbai Municipal Corporation’s (BMC) decision of not giving a water connection until the association submits a no-objection certificate (NOC) from the collector and the assessor was dismissed by the Bombay high court on Monday.

A petition filed by the Mumbai Cricket Association challenging the Brihanmumbai Municipal Corporation’s (BMC) decision of not giving a water connection until the association submits a no-objection certificate (NOC) from the collector and the assessor was dismissed by the Bombay high court on Monday.

A division bench of justice DK Deshmukh and justice RG Ketkar observed that the association could not challenge a communication issued to them in 2006.

“The BMC had imposed the condition in 2006 and you (MCA) come to court in 2010. We cannot allow such petitions," justice Deshmukh observed.

MCA argued that they approached the court in 2010 as their requirement for water connection arose only last year.

“The association cannot be given water connection as the assessor has not yet given the NOC. If they get the requisite documents and apply afresh, then the BMC could decide as per law,” advocate Preeti Purandhare appearing for the civic body argued.
