MCG, contractor asked to file reply

The district court has sought replies from the Municipal Corporation of Gurgaon (MCG) and a contractor by July 25 on a petition alleging the use of inferior quality material in the construction of a road in Sector 12.

The district court has sought replies from the Municipal Corporation of Gurgaon (MCG) and a contractor by July 25 on a petition alleging the use of inferior quality material in the construction of a road in Sector 12.

The directions came on Tuesday, while the court was hearing the petition filed by two residents — Col SS Oberoi and OP Kataria — against the civic body and the Haryana Urban Development Authority (Huda). They charged Huda of illegally constructing the road.

The petition was filed under sections 41, 42 and 43 of the Haryana Municipal Act, 1994, and Section 13 of the Haryana Urban Development Regulation Act, 1977.

While civil judge (senior division) Vijay Singh ruled that the defendants — MCG and the contractor — must submit their replies by July 25, the contractor, Pankaj Gandhi, blamed the civic body instead.

He said, “We were working as per the instructions given by the executive engineer. Even on June 1, when we were allotted the project, we had said the contract was not according to the approved DNIT specifications, but we were told to start work.”

AK Maggu, the executive engineer concerned, was not available for comment.
