The Maharashtra government has set into motion the process for prosecution of Mohammed Ajmal Amir Kasab, the only terrorist taken alive during the November 26 terror attacks in Mumbai, by appointing Ujjwal Nikam the special public prosecutor.
A special sessions court would be set up for the trial, the notification issued on Tuesday said.
The next step for the state government would be to seek the Centre’s nod to prosecute Kasab for offences such as “waging war against the state”, sources told HT on condition of anonymity as they’re not authorised to speak to the media.
Under Sections 188 and 196 Cr.PC, the state government has to obtain the Centre’s sanction to prosecute Kasab. Section 188 deals with offences committed on any ship or vessel registered in India and the other second deals with offences against the state (India).
Nikam, considered an expert at terror cases, appeared in the 1993 bomb blast case, securing conviction of 100, including actor Sanjay Dutt.
