No early hearing in Ujjain case

The Supreme Court on Tuesday refused to grant an early hearing to a petition by Himanshu Sabharwal, son of Prof. H.S. Sabharwal who died after being allegedly assaulted by ABVP activists in Ujjain last month. Sabharwal had sought a CBI probe into the incident.

The Supreme Court on Tuesday refused to grant an early hearing to a petition by Himanshu Sabharwal, son of Prof. H.S. Sabharwal who died after being allegedly assaulted by ABVP activists in Ujjain last month. Sabharwal had sought a CBI probe into the incident.

“What is the hurry?” a three-judge bench headed by Justice B.N. Ahrawal asked when senior counsel Vivek Tankha mentioned Himanshu’s petition for an early hearing.

On Tankha seeking security for the petitioner, the bench advised him to approach the High Court. Himanshu has already approached the NHRC with a similar plea.

The matter will now come up for hearing on September 25. Professor Sabharwal had died after being attacked by unruly students following the cancellatioin of students union elections at Madhav College, Ujjain, on August 26. Madhya Pradesh ABVP president Shashi Ranjan Akela and secretary Vimal Tomar were arrested by the CID in connection with the case following a complaint lodged by Komal Singh Sengar, a peon of the college.
