A Bench comprising Justice BP Singh and Justice RV Raveendran, however, asked Sadhu Yadav to approach the Patna High Court for anticipatory bail in the case.

The Patna High Court had earlier refused to entertain his plea on the ground that the same had then already been decided by the Delhi High Court.

The petitioner's counsel pointed out that the Patna High Court's refusal to entertain the petition on merits was not justified as the Delhi High Court had mentioned in its order that the petitioner should approach the Patna High Court for relief.

The apex court directed that the Patna High Court would decide the petition on merits if the accused filed one.
