The Gujarat High Court on Friday dismissed a petition seeking a stay on a probe by the Supreme Court-appointed panel against Chief Minister Narendra Modi and his cabinet colleagues for their alleged role in the 2002 communal riots.
Delivering his order, Justice D H Vaghela said the special investigation team (SIT) was working under the supervision of the Supreme Court. So, the High Court could not intervene in the matter.
The High Court struck down a petition by former BJP MLA from Lunavad K H Malivad, seeking a stay on the probe.
The case relates to a petition filed by Jakia Ahesan Jafri (65), widow of former Member of Parliament Ehsaan Jafri, killed on February 28, 2002 at Ahmedbad’s Gulbarg Society.
In the complaint Jafri had alleged that Modi his cabinet colleagues, police and administration officials aided and abetted the riots. Based on her plea, the Supreme Court directed the SIT to probe the charges against Modi and 62 others.
