Pay parity: HC directive to CS

HEARING A petition filed by public prosecutors of UP seeking parity in the pay scale with their counterparts in the Central Bureau of Investigation, the Allahabad High Court directed the chief secretary, UP government, to decide the representation of petitioners.

HEARING A petition filed by public prosecutors of UP seeking parity in the pay scale with their counterparts in the Central Bureau of Investigation, the Allahabad High Court directed the chief secretary, UP government, to decide the representation of petitioners.

Passing this directive, a Division Bench comprising Justice VM Sahai and Justice Barkat Ali Zaidi, directed the chief secretary to decide the said representation within three months.

The court passed this order on a writ petition filed by Rajendra Yadav, president of the UP Prosecuting Officers’ Service Association.

It was contended in the petition that in 1986, an equivalence committee was set up by the State government and on the basis of the report submitted by this committee, the same pay-scale was given to public prosecutors of UP as is given to public prosecutors of CBI.

Thereafter, the Fifth-Pay Commission in 1996 gave the same pay scale to the public prosecutors of UP and public prosecutors of CBI.

However, on March 14, 2000, the pay-scale of public prosecutors of CBI was revised by the Central Government, but the same pay-scale was not been given to the public prosecutors of Uttar Pradesh by the State government.
