THE DISTRICT administration has decided to issue notices to all 57 occupants of the Mahmudabad properties asking them to furnish proof of their pre-1965 tenancy to avoid eviction. The tenants have been given time till September 19 to submit relevant documents to establish their claim in this connection. The Supreme Court had made it clear in its September 8 order that “Persons claiming possession, prior to the appointment of the Custodian declaring the property of Raja of Mahmudabad as enemy property, based on duly authenticated tenancy created by the then Raja of Mahmudabad or his general power of attorney, shall not be covered by this court’s October 21 judgment.”

“The process of serving fresh notices to the occupants has been initiated and would be completed by Friday,” said sub–divisional magistrate Manoj Rai, managing officer of the enemy property. He said a missive to ensure compliance of apex court’s order at the earliest was also received from the Mumbai-based Custodian of Enemy Property. All post-’65 tenants, who do not vacate their premises by Tuesday, could be evicted forcibly thereafter anytime by the administration. Not willing to take any chances on the issue of determining the pre and post-1965 tenancy, the officials have shifted the onus on the occupants by asking them to present documentary roof to back their respective claims. But going by records, only 22 out of the total 57 tenants belong to the post-’65 category. This includes 13 occupants in Lawrie Building Hazratganj and nine in Mahmudabad Mansion opposite Halwasiya Market who had decided to knock the door of the apex court again for relief. Lawrie Building tenants comprise those Janpath Market shopkeepers, who have extended the respective portions of their shops onto the Raja’s property behind it allegedly in excess of the land that was originally allotted to them by the managing worker of enemy property.
They include Mahatex, Modern Book Sons, Bansal and Sons, Ghanshyam Opticals, The Shop, Messers Keshav House, A Sons, MM Durga Store, Pantaloon Shop, Ambika Electronics, Kesri Sweet, Lucknow Chikan Palace and Anu Advertising. Likewise, the nine tenants of Mahmudabad Mansion, who would reportedly have to vacate the portion of their respective establishment allotted to them after 1965 include Fairdeal Agencies, Sharma Accessories and Enterprises, Manocha Furniture, Kalpatru, Atar Rashtriya Vidyapeeth, Ganga Corporation Pvt Limited, UP Asbestos and Remington shop. The lucky 35, who got last-minute reprieve from the court comprise two in Lal Kothi in Moulviganj, four in Lawrie Building, five in Mahmudabad Mansion, nine in Siddique Building in Astabal Charbagh and 15 in Imambara Malka Zamania in Golaganj.
