THE ALLAHABAD High Court ordered reinstatement of a sub-inspector and ruled that to resile from the promise to marry a girl was not a misconduct under the relevant service rules. Therefore, the court held that awarding punishment of dismissal from service to the petitioner, who was a sub-inspector with the Uttar Pradesh Police, was wholly disproportionate and cannot be sustained merely because a woman had made a complaint and allegations that the petitioner had failed to execute the promise made by him to marry her.

This judgment was given by Justice Sishir Kumar on a writ petition filed by Huzbas Uddin Khan. The court directed the respondent authorities to reinstate the petitioner in service, but keeping in view the facts and circumstances of the case, the court directed that the petitioner may not be paid 75 percent back wages.
