Relief for Todi, SC drops murder from Rizwan case

In a relief to Ashok Kumar Todi, owner of the Rs 200-crore hosiery brand Lux Cozi, the Supreme Court on Tuesday set aside a Calcutta high court order directing the CBI to probe teacher Rizwanur Rahman’s death as a murder case.

In a relief to Ashok Kumar Todi, owner of the Rs 200-crore hosiery brand Lux Cozi, the Supreme Court on Tuesday set aside a Calcutta high court order directing the CBI to probe teacher Rizwanur Rahman’s death as a murder case.

The bench, headed by justice P Sathasivam, held that the agency should probe the industrialist’s role in the death of the computer graphics teacher under charges of abetment of suicide, in which Todi, his brother and brother-in-law are accused.

The bench permitted the CBI to proceed against the accused police officers and other accused in accordance with law.

Rizwanur’s family reacted to the verdict saying it was a setback. “We still believe that my brother was murdered,” said Rizwanur’s brother Rukbanur Rehman. “However we welcome the verdict of the judiciary… We want the proceedings to eventually lead to appropriate punishment for the guilty.”

The SC verdict, which comes on appeals filed by CBI and Todi, said the high court’s May 2010 order which directed the CBI to pursue with the matter as a murder case was unacceptable.
