The order to the effect was passed by a vacation Bench comprising Justice Arijit Pasayat and Justice CK Thakker on a petition filed by one Vishwanath Chaturvedi from Uttar Pradesh alleging that the Chief Minister and his family members have accumulated assets more than their known source of income.

However, the Bench kept open to examine the bonafide of the petitioner after Yadav's counsel Mukul Rohtagi alleged that his credentials have to be examined.

Chaturvedi, in his petition, has alleged that the Chief Minister has amassed wealth worth crores of rupees by corrupt means and misusing his official position.
