The Supreme Court has asked the subordinate courts to refrain from directing reassessment and production of answer sheets for inspection by students unless it is proved that the evaluation was done contrary to the norms fixed by the examination authority.
A bench comprising Justice Arijit Pasayat and Justice LS Panta said, “The courts normally should not direct the production of answer scripts to be inspected by the examinees unless a case is made out to show that either some of the questions have not been evaluated properly or it has been done in contrary to norms fixed by the examining body.”
With the ruling, SC allowed the appeal by the West Bengal Council of Higher Secondary Education (WBCHSE), which had challenged the Calcutta High Court judgement directing the Council to re-examine the answer script of a student who had appeared in the Madhyamik (Secondary) Examinations conducted by it.
