SC refuses to entertain RJD MP Shahabuddin's petition challenging Patna HC's order to constitute special courts to try him in jail.

The Supreme Court on Friday refused to entertain RJD MP Shahabuddin's petition challenging Patna High Court's order to constitute special courts to try him in jail.

A bench of Justice GP Mathur and Justice Talveer Bhandari asked him to approach the Patna High Court and challenge the latter's administrative decisions in judicial proceedings under article 226 of the constitution.

The bench pointed out that the petitioner has not submitted copies of the High Court's notification dated May 20 and in the absence of the said document, the petition could not be considered.

As the court made it clear that it would not entertain the petition, his counsel chose to withdraw it and the same was "dismissed as withdrawn".

However, on the request of the petitioner's counsel, the court asked the Patna High Court Registrar General to make available a copy of the notification to the accused.

The High Court had ordered constitution of special courts under Bengal, Agra and Assam Civil Courts Act to try Shahabuddin's cases. However, his counsel contended that the Act was not applicable in this case and hence the High Court's notification was bad in law.
