SC to hear plea challenging Nithari serial killer's commutation

The Supreme Court on Monday issued notices to Surender Koli, sentenced to death for the Nithari serial killings, and others on the Uttar Pradesh government's petition challenging the commutation of his sentence to life imprisonment.

The Supreme Court on Monday issued notices to Surender Koli, sentenced to death for the Nithari serial killings, and others on the Uttar Pradesh government's petition challenging the commutation of his sentence to life imprisonment.

A bench headed by Chief Justice HL Dattu agreed to hear the state government's plea seeking the death sentence for Koli in one of the cases related to the 2006 killings.

The court issued notices to Koli, the Central Bureau of Investigation (CBI) and others.

The Uttar Pradesh government has challenged the Allahabad high court's verdict commuting Koli's death sentence to life imprisonment in one of the cases. The high court had commuted the death sentence because of an "inordinate delay" in deciding Koli's mercy petition.

Koli was sentenced to death for the rape and murder of a girl called Rimpa Haldar at Nithari village in February 2006.

The high court had issued the order in response to a public interest litigation filed by the People's Union for Democratic Rights, which argued that executing Koli would violate his constitutional right to life because no decision had been made on his mercy petition for more than three years.

He was accused of killing several children and dismembering their bodies.

In 2009, a special court found Koli and Pandher guilty of the murder Rimpa Haldar and sentenced them to death. Koli was subsequently sentenced to death in four more cases.
