The Supreme Court will on September 29 give its verdict on the government's move of providing relief to traders by allowing commercial activities in the residential areas.
After a marathon three-hour hearing, a Bench headed by Chief Justice YK Sabharwal reserved its order and expressed disapproval over the manner in which notifications were issued after the court orders on the issue.
"The orders of the court would not be modified automatically by the notifications," the Bench, also comprising Justices CK Thakker and RV Raveendran, said, referring to the government's notifications since its February-16 verdict that the MCD had powers to seal illegal commercial premises in residential areas.
The court said the sequence of events from March 28, the day the government came out with the change in the provision on the mixed land use, will make it clear about the developments on the issue of commercial establishment in residential areas.
Referring to various other contentious issues which Delhi witnessed in past years like shifting of hazardous industries, unauthorised construction, CNG matter etc, the Bench said "everytime utmost resistance comes from those who have to implement the law".
The court said even if some relief as interim measures was to be given, the rule of law and authority of law remains to be maintained.
