Shahabuddin's trial in special court

Patna HC directs the hearing of Md Shahabuddin's case to be conducted by a special court, reports Prashant Pratap.

The Patna High Court has directed that the hearing of Session Trial (ST No. 63/2004) involving Siwan parliamentarian, Md Shahabuddin, would be conducted by a special court constituted by the state government in this regard.

As about two years ago, the High Court, while hearing the bail plea of the Siwan MP, in connection with a kidnapping case, had directed the Siwan District and Sessions Judge, to conduct the trial of the concerned case arising out of the Siwan Muffasil PS case no 08/2001.

In June 2006, the Bihar Government, however, had constituted a Special Court at Siwan to conduct the cases involving Md Shahabuddin.

Under the changed circumstances, the Siwan District Judge had requested the High Court for issuance of necessary direction with regard to hearing of the session trail (ST No 63/ 2004) by DJ's court or the designated Special Court in this regard.

After hearing the MP's counsel, Raju Giri and the State Counsel, Shameshwar Dayal, Justice VN Sinha, passed the order relating to the trail (ST No 63/2004) by the Special Court. However, the bench clarified that the direction would be the subject matter of the result of criminal writ filed by the Siwan MP, challenging the State notification for constitution of a special court.
