The woman, identified as Rubi, married Sakhawat Husain at Bhagijot village on August 11.
Some Muslim clerics ruled the marriage was illegal because she had not got a divorce from her first husband.
The matter was taken to the Shariat court at Nagina town in Bijnor, which has summoned the parties concerned to appear for a hearing on Thursday.
Mufti Mohd Uvais, who will head the court, said it was a serious issue and the case would be decided after considering all evidence.
