Single judge?s order partially stayed

A DIVISION Bench of the High Court in twin special appeal, has partially stayed the order of Justice DP Singh, passed on January 19, last, whereby he had quashed the selection of Class III and IV employees of Barabanki district judgeship held in 2004 on the grounds of gross irregularities, while imposing a cost of Rs 1 lakh on the district judge Barabanki SB Vaish.

A DIVISION Bench of the High Court in twin special appeal, has partially stayed the order of Justice DP Singh, passed on January 19, last, whereby he had quashed the selection of Class III and IV employees of Barabanki district judgeship held in 2004 on the grounds of gross irregularities, while imposing a cost of Rs 1 lakh on the district judge Barabanki SB Vaish.

Justice Bhanwar Singh and Justice DV Sharma, by an interim order, has stayed that part of the aforesaid order (of the single judge) by which selection of Class IV employees was quashed and a cost of Rs 1 lakh was imposed on the district judge Barabanki. Besides, the above selection process to be held afresh, as ordered by the single judge, has also been stayed by the Bench. The Bench passed the above orders on twin special appeals preferred by the District Judge Barabanki SB Vaish and the affected employees, respectively, which were heard together.

Justice DP Singh, on January 19, while allowing a writ filed by one Dinesh Kumar and others, challenging selection of Class III and IV employees of Barabanki District Judgeship on the ground of gross irregularities had passed the aforesaid order. The matter shall come up for hearing on February 23.

Missing detenue: In a piquant situation where one Ravi Shanker Gupta alias Chaman was said to have been detained by the police, while on the contrary, the said fact was denied by the concerned police, the Lucknow bench has directed the State to conduct an inquiry into the matter by an IPS level officer, within five days.The matter shall come up for hearing on February 23.
