State sop to protect rights of tenants

Before any new redevelopment projects for the 16,052 buildings take off under the recently amended Development Control Rules 33 (7), the state government has added another pointer to protect the rights of tenants.

Before any new redevelopment projects for the 16,052 buildings take off under the recently amended Development Control Rules 33 (7), the state government has added another pointer to protect the rights of tenants.

Chief Minister Ashok Chavan on Friday cleared an Urban Development Department (UDD) proposal to make sure every tenant has a legal right to stay on in the new construction.

Amending earlier norms, the department has now made it mandatory that an agreement be signed with every individual tenant before redevelopment of any building is approved.

“Earlier, there used to be a tripartite agreement between society of the tenants, the owner and the private developer or MHADA,” said T.C. Benjamin, principal secretary, UDD.

He added that now instead of a tripartite agreement, the developer would have to make a separate agreement with every tenant. This move is expected to protect the rights of tenants against rich developers.

There have been many complaints in the past where rightful tenants have lost out on their new homes and languished in temporary accommodation because of lack of individual papers.
