The case, filed two decades back by Ashok Kumar Singh, relates to the murder of Sitaram Singh on the day of by-poll in Barh constituency on November 16, 1991. The complainant in his FIR had named Kumar as the main accused along with four others persons, late former minister Dilip Singh, criminal turned politician Dularchand Yadav, Yogendra Yadav and Bodhu Yadav. The Chief Minister was then the candidate of the erstwhile-old Janata Dal from Barh parliamentary constituency and pitted against Congress candidate Siddeshwar Prasad.

In its order issued on August 31st, the additional CJM has said that a prima facie case for the offense under section 147, 148,149, 302,307 IPC and 27 arms act was being made out against the accused persons for which cognizance had been taken against them.
