Surrender before CBI magistrate

Monday morning's drama began at the CBI Special Judicial Magistrate (SJM) court in Ghaziabad where Aarushi Talwar's mother Nupur Talwar surrendered.

Nupur, her husband Rajesh Talwar and family members reached the court at 9.45am after which they were taken through the judges' chambers.

On April 27, the Supreme Court had ordered Nupur to appear before the SJM court, which had issued summons, bailable and non-bailable warrants after she skipped hearings.

The hearing began at 10.15 am when Nupur's counsel produced her surrender application and her bail plea before CBI SJM Priti Singh. In February, the magistrate had issued summons against the couple.

Talwar's counsels argued that she should be provided relief as she was "a lady", was "innocent" and had "not committed any offence." CBI senior public prosecutor RK Saini said that bail under section 437 of CrPC was not mandatory for a woman.

"She is not an innocent lady as the Ghaziabad court, prima facie, found a case against her which was upheld by the HC and the Supreme Court. She is evading arrest," Saini argued.
