Telecom tribunal TDSAT on Wednesday issued notice to the government on a petition filed by Anil Ambani Group's Reliance Communications, seeking withdrawal of additional spectrum held by rival GSM operators.
The Telecom Disputes Settlement and Appellate Tribunal also allowed the request of Reliance Communications Ltd and directed to implead eight GSM operators, including the trio Bharti Airtel, Idea, Vodafone Essar, as a party.
However, the tribunal declined to pass any interim order at this stage. The RCom counsel contended that the Department of Telecom (DoT) had alloted additional spectrum to GSM operators, although they were not entitled.
"They gave spectrum in violation... Even granted more for which they were not even entitled," the counsel for RCom alleged, while requesting the tribunal to implead the GSM operators in this case.
On being asked by the tribunal as to when the allotment started, RCom's counsel said from September, 2006.
Later, the tribunal directed all the parties including DoT and GSM operators to file their replies in four weeks.
It also directed RCom to file rejoinder to its reply within four weeks and directed to list the case on March 25.
