The Delhi high court on Friday granted bail to former army officer Lt Gen (retd) Tejinder Singh who was arrested on Monday for allegedly offering a bribe to former Army chief Gen VK Singh.

Tejinder Singh was arrested for allegedly offering a bribe of Rs 14 crore for clearing files pertaining to the procurement of Tatra all-terrain vehicles.

The HC trashed CBI’s apprehension that Singh has the capacity to influence the witnesses, saying that the agency did not make any such complaint against him during the two-year long probe.

It granted bail to Singh on a personal bond of Rs 1 lakh and a surety of the like amount while imposing certain conditions — including a restriction on his leaving the country without prior permission and the instruction that he would not contact any of the case witnesses during the trial.

Referring to various judgments, the court said it has been a settled legal position that if an accused has not been arrested during the probe and has roots in the society then he should not be arrested after filing of the chargesheet.
