The Rajasthan government reinstated suspended IPS officer Dinesh MN, one of the accused in fake encounter of Sohrabuddin Sheikh in 2005, on Friday.

Confirming the news, a senior department of personnel official said Dinesh has been reinstated under section 3/7 (a) of All India Services (discipline and appeal) rule 1969.

He was suspended in April 2007.

The subsection of section 3/7 (a) states an order of suspension made or deemed to have been made under this rule shall continue to remain in force until it is modified or revoked by the authority competent to do so.

On reinstating Dinesh, the official said he was behind bars for close to seven years but charges were not framed against him nor regular trials were held.

The senior government official said: “There is a competent authority under the chairmanship of chief secretary and other members which reviews suspensions which are over three years. The committee has taken the decision to reinstate Dinesh.” he said. He added the IPS officer will be joining the police headquarter for now.

The Bombay high court had granted bail to Dinesh last week against a solvent surety of Rs one lakh and asked to appear on first Sunday of every month before the CBI court in Mumbai.

The Supreme Court in 2012 had shifted the trial to Maharashtra from Gujarat. The alleged encounter occurred near Gandhi Nagar (Gujarat). There are 23 accused in the case, including Dinesh.
