Drawing comparison with the case of 1993 Mumbai blasts convict Yakub Memon, Central Bureau of Investigation (CBI) on Tuesday sought capital punishment for other accused Mustafa Dossa and Firoz Khan too.
Memon was awarded death penalty and hanged on July 30, 2015. He was called as one of the key conspirators in the case as the court had observed that he followed and worked on the instruction of his elder brother Tiger Memon.
“Role of Dossa is more serious than that of Yakub Memon and Khan’s role was almost similar,” said special public prosecutor Deepak Salvi.
Salvi called Dossa as one of the ‘masterminds’ of the blasts. “Dossa instructed his men in India to execute the conspiracy. He and his elder brother Mohammad Dossa, an absconding accused, had called for the first meeting where all the gangsters had met. It was in this meeting that people were instigated to carry out the blasts in the city,” Salvi added.
Salvi said Dossa was a “driving spirit” behind the blast and the true “architect” of the conspiracy. “Dossa sent huge consignments of arms and ammunitions through his smuggling network which was used in the blasts and had also arranged for the training of the accused. He was the archer who gave instructions to his men on where to collect the consignment and also arranged for travel of the accused to Pakistan for arms training,” said the prosecution.

{{/usCountry}}After Dossa, the prosecution alleged that Khan worked parallelly with Memon. “Khan was an active member of Dossa’s gang and was one of the prime conspirators. He played an active role in the landing of arms and ammunitions sent by Dossa on the west coast of India. He further actively participated in distribution of the consignment of arms and ammunitions to further destinations,” Salvi added.
The public prosecutor said Khan was also in the position of preventing the incident had he taken a call to inform the police. In fact, Khan, on the instruction of Dossa, attempted to destroy the remaining arms and ammunitions to escape arrest, the counsel said. “The convicts have no repentance. They have tried to delay and obstruct the trial on several occasions,” Salvi said.
The prosecution will continue to make submissions on quantum of sentence against the remaining four convicts.
