Bombay high court grants bail to Sangli resident booked for raping girlfriend

The Bombay high court recently granted anticipatory bail to a man accused of raping his girlfriend, whom he had allegedly cheated by refusing to marry her.

The Bombay high court recently granted anticipatory bail to a man accused of raping his girlfriend, whom he had allegedly cheated by refusing to marry her. The 30-year-old woman had divorced her husband to marry the man who is from Tasgaon in Sangli district of southern Maharashtra.

According to the FIR registered with Tasgaon police station on December 22, 2016, the complainant and the man resided in the same village.

“Prima facie, no offence of rape is made out,” said Justice Mridula Bhatkar while granting the pre-arrest bail to the man.

Although the affair continued for sometime, the man was not willing to marry her, citing family responsibilities, and therefore, the complainant married some other person on May 1, 2014.

In her complaint, she said even after the marriage she continued to receive messages and phone calls from him. Five days into the marriage, when she visited her maiden home, the accused called her to meet him. She further alleged that when she reached the spot he purportedly induced her to have physical relation, and did not allow her to return back to her husband.

Justice Bhatkar, however, refused to believe in the complainant’s claim, saying she was 26-27 years old when the purported inducement took place.
