The division bench of chief justice Mohit Shah and justice MS Sanklecha also sought to know if the governor would like to add some terms to the terms of reference of the Chitale committee.

The bench has requested advocate general Darius Khambata to seek the response from the Governor by July 12.
The water resources department and the development boards are supposed to provide necessary information to the committee.
The lawyer further pointed out that since the development boards and water resources department are facing enquiry, they may not provide information adverse to their interest and therefore other persons having material should also be allowed to participate in the enquiry.
The bench felt it necessary to seek the governor’s response in view of the wide powers available to the highest authority of the state under Article 371(2) of the Constitution of India.
