‘Decide on proposal to prosecute corrupt cop’

The division bench of justice BH Marlapalle and justice UD Salvi, of the Bombay high court, on Wednesday, also asked public prosecutor PA Pol to submit details of mobile phones used by police officers. The court gave Pol an additional two weeks to submit the information, which was sought by the court after it was brought to its notice that Khade had used somebody else’s phone for demanding money from the petitioner, Aminudding Saeed.

Saeed, in his petition, said he began receiving threats in December 2009 after filing the PIL alleging the BMC illegally gave the development rights for Sitaram Building, near Crawford Market. The petition said Saeed not only lodged a non-cognisable complaint about the threats, but also wrote to various authorities.

Thereafter when Saeed approached ACB on February 8, he was given a recording device and a conversation between him and Khade was recorded, yet no action was taken, he alleged. On February 15, a rape case was lodged by a woman against Saeed and Reshamwala and they spent over three months in custody.

Commissioner of police, Sanjeev Dayal had tried to justify the ACB’s inaction by saying Khade had not demanded anything for himself and he did so, on behalf of a complainant who accused Saeed of rape.
