HC cancels bail granted to Palande

Palande is presently in jail in connection with last year’s murders of senior citizen Arun Kumar Tikku and aspiring producer Karan Kakkad.

“The discretion of the court to suspend the sentence has been misused by the respondent [Palande],” the division bench of justice PV Hardas and justice AM Thipsay observed. It also cancelled the order suspending the life term handed down to Palande in connection with the 1998 case of kidnapping and murder of businessman Swaraj Das.

Palande challenged his 2002 conviction in the kidnapping and murder case and acting on his plea, in 2007, the HC had suspended his conviction and the substantial sentence of life imprisonment. The court had also ordered him to be released on bail pending the appeal.

The state had moved a plea seeking cancellation of the bail after he was arrested last year for murdering Tikku.

Palande had opposed the plea saying he had not breached the HC’s condition. He argued that he had complied with the condition of reporting to the police station regularly.

Countering the contention that he had committed seven offences while on bail, Palande took a stand that he had been falsely implicated in all of them.

The bench, however, found substance in Deshmukh’s contentions and cancelled the bail.
