Ava Kaka, who gave her Class 10 board exams from JB Petit school, Fort, with a score of over 80%, had moved the court after the state refused to accept her application on June 12.

According to the petition, Kaka had uploaded her form for stage one, however, the authorities refused to accept the subsequent forms stating that she was only eligible to apply offline.

Kaka’s lawyer said she was exempted from one exam – the second language – following due process, owing to her dyslexia. Consequently, she had written exams for five of six subjects.

The state said Kaka was not being prevented from applying, but could apply offline after the online procedures had ended, since the state followed a best-of-five policy that had been endorsed by the Supreme Court.

A division bench of chief justice Mohit Shah and justice MS Sanklecha said that just because other students had not taken advantage of the provision for exemption, it did not mean the petitioner could not.

Following state’s query, the court also clarified that other such students can also do likewise.
