MHADA’s eviction process eased

The Maharashtra Housing Area Development Authority (Mhada) recently received major relief from the Bombay high court, which allowed the authority to use summary proceedings to evict trespassers occupying their transit accommodations for years.

The Maharashtra Housing Area Development Authority (Mhada) recently received major relief from the Bombay high court, which allowed the authority to use summary proceedings to evict trespassers occupying their transit accommodations for years.

The summary proceedings under Section 95A(3) of the Mhada Act will allow the authority to cut short the cumbersome eviction process from more than a decade to a month or two. Earlier, the housing authority was required to follow a legal procedure, which according to Mhada counsel GW Mattos would sometimes take even 15-16 years to conclude.

The division bench of justice DY Chandrachud and justice Anoop Mohta were deciding a petition filed by eight trespassers in Mhada’s Gorai Transit Camp.
