A Shivaji Park resident has sought action against the Brihanmumbai Municipal Corporation (BMC) and the administrators of her building, for not repairing the structure despite parts of it having collapsed recently.
A division bench of justice RK Deshpande and justice VL Achliya was hearing a petition filed by Joyce Rath Nath, a resident of Rath Mansion, Mahim, which states parts of the building have collapsed three times, including twice in May this year.
Nath wants the civic body to urgently repair and restore the dilapidated structure.
Her petition claims the water tank in the A wing of the three-storey building has been leaking since 2009.
After a part of building collapsed in July 2013, the fire brigade and the Shivaji Park police has asked the administrators and the BMC to structurally stabilise and repair the water tank, terraces and the collapsed parts. But no action was initiated.
Two more incidents of collapse took place recently May 8 and May 22 this year, says the petition. While several complaints have been filed with the BMC and the police, the civic body has failed to take any action, it claims.
“This is the third monsoon when our lives are at stake. Instead of engaging a reputable structural consultant to initiate repairs of the collapsed sections, a labourer was hired to fix tin sheets on the terrace doors. Now, the doors don’t shut, which means the rain water will sweep in and further weaken the building,” Nath told HT.
