Justice D.G. Karnik observed that there had been inordinate and unexplained delay by the government in coming to the court for canceling Gawli’s bail.

Agreeing with arguments of Gawli’s advocate I.P. Bagaria, Justice KArnik observed, “There is no need for custodial interrogation.”

Although the sessions court had rejected the cancellation of bail application by government in May 2007, government approached HC only in January 2008. Gawli is behind bars for his alleged role in murdering Shiv Sena corporator Kamlakar Jamsandekar on March 2, 2007.
