The state government started work on the draft master plan in 2008 by mapping areas in need of new schools. While the survey was on, proposals for new private primary and secondary schools were put on hold. The affidavit states: “The state government has proceeded to complete the master plan…and has already prepared and notified the draft master plan and invited objections and suggestions over the same.”

Based on the objections and suggestions, the state government prepared a detailed report, which was presented to the cabinet of ministers. The report has now been sent to the planning, finance and law and judiciary department for remarks and suggestions. A bench comprising justice DK Deshmukh, justice Anoop Mohta and justice KK Tated was hearing petitions filed by Shikshan Mandal and others . One of the issues raised was that though the government accepts proposals from English medium schools, it has not been accepting any for unaided Marathi schools for four years. The state conveyed that it does not differentiate between schools on the basis of language of instruction.
