Court rejects Indrani’s bail plea after CBI says she’s fine

A local court on Friday rejected the bail application of Indrani Mukerjea, who is an accused in the Sheena Bora murder case. The court has allowed private medication and treatment if needed.

A special CBI court on Friday rejected the bail application of Indrani Mukerjea, who is accused of murdering her daughter Sheena Bora, but permitted her medical care.

Indrani had filed the bail plea on February 5, stating that she needs treatment for her deteriorating health to face trial. The application read: “Given [Indrani’s] deteriorating medical condition it is essential in the interest of justice that the applicant be [granted] bail and allowed proper medical care and comfortable environment for recovery so that she can efficaciously prepare for the trial and face it.”

Indrani’s bail application was filed under Section 437 of the Criminal Procedure Code, which relates to granting a woman suspect bail on health grounds. Relying heavily on medical reports from JJ Hospital and her poor health, Indrani’s bail application stated that she needs proper medical care, which is not possible while she is in judicial custody.

The CBI had objected to the bail plea, saying that according to the team of the doctors who examined Indrani, she is on the path to recovery and is getting all the treatment she needs in jail. The CBI’s lawyer contended that Indrani has been examined by 12 different doctors, each of whose statements have been recorded. The lawyer claimed that whenever she has complained of any health problem, she has been examined by a doctor but her reports have come out fine. “She is on the path to recovery and recent reports suggest that her weight is also stable. She has been given proper medical treatment, a high-protein diet and dry fruits from the jail canteen. All the doctors have said that she is fine now,” the CBI’s lawyer said.
