Forum orders Railways to pay Rs 9 lakh as compensation

Gurdaspur District Consumer Disputes Redressal Forum has directed the railways to pay a compensation of Rs 8.7 lakh to the family of a woman who had died in a mishap on the train.

Gurdaspur District Consumer Disputes Redressal Forum has directed the railways to pay a compensation of Rs 8.7 lakh to the family of a woman who had died in a mishap on the train.

Complainant Jatinder Sexena along with his minor daughter Neha and son Sahil had approached the forum with the grievance that he, along with his family, including his wife Meenu, was travelling by Shalimar Express from Jalandhar to Pathankot on January 27.

Suddenly, the upper berth of the coach in which Meenu was sitting got displaced and fell down. Meenu, who suffered serious injuries, was taken to the hospital, where she succumbed to her injuries.

The complainants demanded compensation from the railway authorities for negligence and deficiency in service and also for the untimely death of Meenu.

But the railway authorities denied that they were liable to pay any compensation to the complainants.

Sanjay Garg, president of the forum, observed that there was sufficient evidence in the shape of medical evidence and FIR to prove that Meenu had suffered grievous injuries on her neck due to falling off of the berth.

The compensation amount is to be paid within 30 days from the date of receipt of the copy of the order, failing which the amount would be payable along with interest at the rate of 9% per annum.
