On a petition filed by the plot-holders welfare association, challenging the no objection certificate (NOC) being demanded by the revenue department officials while registering sales deeds in the state, the Punjab and Haryana high court on Monday issued notice of motion to the state government for October 29.
The notice was issued by Justice Rameshwar Singh Malik while accepting the petition.
Vikas Behl, counsel for the petitioners, told HT, "The revenue department had banned the registries of the properties situated in unapproved colonies in the absence of the NOC. When the owners approached the civic authorities to issue the NOC, they started demanding regularisation charges. The entire thing was against the natural law of justice."
He said, "We stressed the point that the need for the NOC applied only to the properties sold by PUDA or any other development authority. For the properties owned by private persons, the demand for the NOC is illogical and they cannot be blatantly covered under the ambit of unapproved colonies and their selling right cannot be forfeited."
The petition was filed by Ashwani Joshi, under the banner of the plot holders welfare association.
Joshi said, "Suppose one wishes to deposit the regularisation charges by selling a portion of his land, he cannot do that as the registration of land is banned if there is no NOC. It means we are forcing the owner to take a loan to get the right to live. It is unjustified and we have challenged the illogical move by the state government."

It means we are forcing the owner to take a loan to get the right to live. It is unjustified and we have challenged the illogical move by the state government."
He said, "There are many flaws and complications in the regularisation policy. In the coming days, we will move the high court seeking legal remedy on regularisation policy also."
Nawanshahr observes symbolic bandh
Meanwhile, on a call by the plot-holders welfare association, all bazaars of Nawanshahr remained closed on Monday.
"It was a symbolic protest from 9am to 1pm and all organisations of the town participated in it. We did not want to harass the public, so the bandh was restricted to a short period. We got an overwhelming response and in the coming days, if the government failed to withdraw the regularisation policy, our protest would be intensified," said Joshi.
At Kartarpur also, the Congress workers staged a dharna under the leadership of former minister Chaudhary Jagjit Singh to mark their protest against the regularisation policy.
