Phagwara-based businessman Surinder Mittal has served a notice for recovery of damage and compensation of Rs 1 crore on Punjab chief secretary, Kapurthala deputy commissioner, passport officer, regional passport office, Chandigarh and five others for registration of a false case against Mittal in 2009.
Advocate Mandeep Singh Sachdeva said in the notice that a false FIR was registered against his client at police station Phagwara city on January 10, 2009, on a complaint from one Sandeep Kaur, a resident of Nasserabad village.
The notice said that Rakesh Aggarwal, the then SSP, being a close relative of Mittal, was nursing a grudge against him and accordingly registered a false and frivolous case against his client.
The notice adds Mittal suffered a lot of loss in his reputation and pecuniary loss of more than 1 crore due to the case. The advocate claimed that Mittal had been acquitted of the charges against him and that his client had decided to file a criminal case for prosecution seeking compensation amounting to Rs 1 crore. The notice was being sent to avoid litigation, he added.
It said that notice has been issued under Section 80 (procedure of arrest of person against whom warrant issued) of the criminal procedure code.
